Terms
What you buy, what you may do with it, and where you stand if something goes wrong. In plain language, because that serves everyone better.
1. Who the seller is
De Raad Software, sole proprietorship of Damian de Raad, based in the Netherlands, registered with the Dutch Chamber of Commerce (KvK) under number 42200414, reachable at info@deraadsoftware.com.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders: Paddle handles the payment, the invoice, the VAT and customer service enquiries about payment. Payment is subject to Paddle’s buyer terms. For use of the software, the terms on this page apply.
2. What you buy
You buy a right of use: a licence to use the software. Ownership of the software and the source code stays with me.
- The licence is perpetual: it does not expire and needs no renewal
- The licence covers the version you buy and all updates within that same major version
- A licence covers one user or, for business licences, the agreed number of seats
- The licence key is verified locally — no internet connection is needed to keep working
3. What you may do with it
Yes:
- Using the software for your work, including commercially
- Making a backup copy
- Installing the software on a replacement computer when you change machines
Not:
- Reselling, renting, lending or distributing the software or your licence key
- Sharing the licence key beyond the number of seats you paid for
- Decompiling or modifying the software, except where the law expressly permits it
- Circumventing the licence protection
4. Withdrawal and refunds
As a consumer you normally have fourteen days to withdraw from a purchase of digital content. That right ends once you download the software or activate your licence, but only if you expressly agreed at checkout to immediate delivery and acknowledged that you thereby lose your right of withdrawal. If you did not, you can withdraw within fourteen days of purchase.
Separately: if the software does not work as described, email me. If I cannot get it working, you get your money back. I would rather sell nothing than something that fails to do what I promised.
Refunds are handled by Paddle: request one via the link in your order confirmation or at paddle.net. Paddle’s refund policy also applies. A refunded licence is no longer valid.
5. Support and updates
- I answer questions about usage by email, usually within a few working days
- I fix errors in the software where reasonably possible
- Updates within the same major version are free
- A next major version may require a new purchase; I will say so in advance
There is no guaranteed response time and no maintenance contract. If you want one, for business use for example, we arrange that separately.
6. Liability
The software is delivered as is. I build it carefully and test it, but I cannot guarantee that it is free of errors or fit for every conceivable purpose.
To the extent permitted by law, my liability is limited to the amount you paid for the licence. I am not liable for consequential damage, lost profit, loss of data or business interruption. This limitation does not apply in cases of intent or wilful recklessness on my part.
7. Changes
I may change these terms for future purchases. For your own purchase, the terms as they read at the moment you bought remain in force. The version date is at the top of this page.
8. Applicable law
Dutch law applies to this agreement. If we cannot resolve a matter between us, the competent court is in the Netherlands. As a consumer you retain the rights granted to you by mandatory law in your own country.
